EM 385-1-1 guide

Which EM 385-1-1 edition governs your contract?

EM 385-1-1 is contract-specific and date-specific. The edition that governs your work is the one in effect on the date of solicitation, and a contract already under way keeps the edition it was solicited under until completion. This guide is about the dates and records. It says nothing about whether any hazard is adequately controlled.

The two sentences that decide it

The current edition is EM 385-1-1, “Safety and Occupational Health (SOH) Requirements,” dated 15 March 2024, which supersedes the 30 November 2014 edition. For construction work under FAR Clause 52.236-13 the manual says: “Contractors must comply with the latest version of this manual (including interim changes) that is in effect on the date of solicitation.” For work already under contract it adds: “Existing contracts will continue to apply the provisions of the previous edition of this manual until contract completion.”

So an older award can be lawfully on the 30 November 2014 edition while a new solicitation is on the 15 March 2024 edition. Combining the two editions in one document is not what the manual asks for: you need one edition, selected by solicitation date.

The obvious download link served the wrong manual

Two separate facts, both true. First, the content at that link has not changed since 5 September 2015 — the Internet Archive digest L54BSTOVQPS6HRASSMSJKJU3NTDIMWCI is identical on dozens of captures from 2015-09-05 through 2026-09-21. Second, that content is the 30 November 2014 edition, which the 15 March 2024 edition superseded. So for roughly two and a half years USACE’s obvious Engineer Manuals link has handed out a retired manual. The current edition lives at a different path: https://www.publications.usace.army.mil/Portals/76/EM%20385-1-1%20_EFFECTIVE%2015%20March%202024.pdf. If you clicked the obvious link and got a 2014 manual, you have the wrong edition for a new solicitation. USACE returns a block (HTTP 403) to automated fetchers, which is why the archive digest is the evidence.

Watch the forms separately from the manual

The manual points at USACE ENG Forms, and a form can be reissued without a new manual. ENG Form 6293 (Accident Prevention Plan Worksheet) is mandatory and is required by §2-7.b(1), cited at §2-10.d. ENG Form 6206 is the manual’s “non-mandatory formatted outline” of an AHA, cited at §1-10.b and §2-10.b. ENG Form 6292 (Site-Specific SOH Plan Worksheet, §1-10.d) is mandatory and was reissued 13 September 2024, six months after the manual. Also mandatory: ENG Form 6282 (SSHO Designation Letter, §2-10.c). ENG Form 6283 (CDSO Designation Letter, §1-10.c) and ENG Form 3394 (Mishap Notification and Investigation, §1-10.a and §2-10.a) round out the manual’s Checklists and Forms paragraph. All of these are free government documents.

The manual’s own broken cross-references

A cited product has to handle the manual’s internal mis-points deliberately. The 15 March 2024 edition says controls follow “paragraph 2-6.a” when the hierarchy of controls is at §2-6.b; it says risk acceptance follows “paragraph 2-6.b” when Risk Acceptance is at §2-6.c; and the AHA-outline note sends you to “para 2-10.a” for ENG Form 6206, which is at §2-10.b. Repeat them and you mislead; silently fix them and you diverge from the text the KO or COR is reading. Show both, flagged as a manual-side error.

Check yours

The free edition check takes a solicitation date and returns the governing edition, the manual’s own two sentences, and the ENG Forms involved. The Filing Desk adds the full currency report and the saved history.
